The States Say “Confirm Amy Coney Barrett Now”

ARLINGTON, VA – (OCTOBER 12, 2020) Today, the American Legislative Exchange Council (ALEC), the voice for states and state legislators in Washington, D.C., released a letter with its sister organization ALEC action, containing nearly 200 state legislator signers, who call for the swift confirmation of Supreme Court nominee Amy Coney Barrett because of her support for limited government, free markets and federalism, which ALEC and its members advance every day.

Amy Coney Barrett’s legal philosophy will preserve the proper function of government – with judges deciding over the law and not creating the law. Barrett will be a bulwark for our constitution. In fact, her legal philosophy supports individualism over collectivism, and supports the importance of federalism – in other words, allowing for local variations across the states.

Barrett agrees with ALEC members that the individual is the primary component in society: “the citizen is thus positioned to demand that his agents explain why legislation … [secures] his natural rights.” Barrett also agrees with ALEC members that one-size-fits-all policy approaches from the federal government discount the uniqueness of each and every state: ”the Court’s holding on a constitutional question stands as a national rule [and] precludes local variation.”

“Amy Coney Barrett is a legal superstar, who when on the bench of the Supreme Court of the United States will judge the law based on the rules of the constitution, which respects state sovereignty” said ALEC CEO Lisa B. Nelson. “United States senators should swiftly confirm Barrett to serve these United States, as they did in 2017.”
