Military Crosswalk Act

Prior to task force meetings, ALEC posts these legislative member-submitted draft model policies to our website. The draft model policies are then discussed, debated, and voted on by ALEC task force members. Policies that receive final approval by legislators on the ALEC Board of Directors become official ALEC model policy. Draft model policies that fail to become official ALEC model policy are removed from the website.

Summary

The Military Crosswalk Act directs the state occupational licensing division, in consultation with the state department of veterans and military affairs, to prepare a publicly available resource that details when military training, education, credentials, skills, or experience are substantially equivalent to civilian occupational licensing requirements. The Act also directs the division to grant appropriate credit to veterans and servicemembers who apply for an occupational license and report outcomes and recommendations back to the relevant legislative committee. 

Military Crosswalk Act

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF _________:  

Section 1. Definitions.   

As used in this section:   

  1. “License” means an authorization that permits the holder to engage in the practice of a profession regulated under this title.  
  2. “Servicemember” means a currently serving member of the armed forces.   
  3. “Division” means the [State Occupational Licensing Division].  

Section 2. Veteran Licensing.    

  1. The division shall, in consultation with the [State Department of Veterans and Military Affairs]:   
    • (a) Identify skills, experience, credentials, training, and education that an individual can obtain in the armed forces;  
    • (b) Determine to what level the skills, experience, credentials, training, and education described in subsection 1(a) are substantially equivalent to current requirements in statute or administrative rule for a license and can substitute for the requirements; and  
    • (c) Prepare and update as necessary a document, spreadsheet, or other resource accessible by the public on the division’s website detailing the information described in subsection 1(a) and (b).  
  2. If a veteran or service member applies for a license and does not meet the current required training or education requirements established in statute or administrative rule for the license, the division shall give credit to the veteran or service member for relevant skills, experience, credentials, training, or education obtained while in the armed forces based on the determination described in subsection 1(b).  

Section 3. Reporting.   

On or before [Two Years After Enactment Date], the division shall provide a report to the [Relevant Legislative Committee] regarding:   

  • (a) The number  of applicants for a license who are veterans or service members that have successfully been granted a license under this section; and   
  • Any legislative recommendations for changes to this section.
