Summary

This act outlines requirements for voter registration lists within a state to ensure accuracy and security of elections. 

Interstate Voter Assistance Act

Section 1. Section [         ] is enacted to read: 

Voter Registration; Collection of Prior Registration Information 

(A) The [chief election official] shall require the state’s voter registration application to be updated to include: 

  1. A space or box for the applicant to indicate whether they have previously been registered to vote in a different state; 
  2. A space or box for the applicant to provide the address where the applicant was registered to vote at the time of submitting the application, including the street number, city or town, state, and zip code, or a detailed description of the location if no street address is available, if applicable. 
  3. A statement and corresponding space for the applicant to sign acknowledging and agreeing to the following: 
    • (i) By completing and submitting this signed application, and upon its approval, I request the cancellation of the registration listed above by the former state pursuant to 52 U.S.C. § 20507(a)(3)(A) and direct the [election official] to forward my request to the [chief election official] of that state.  

Section 2. Section [         ] is enacted to read: 

Voter Registration; Record and Transmission of New Voter Information 

(A) If an individual successfully registers to vote in this state and that individual’s voter registration application indicated they have previously been registered to vote in a different state, the [registrar] shall cause the following information, as available from the processed voter registration information, to be recorded and [periodically] transmitted to this state’s [chief election official]: 

  1. The voter’s full legal name; 
  2. The voter’s date of birth; 
  3. The voter’s social security number [or the last four digits of the social security number]; 
  4. The voter’s driver’s license number; 
  5. Any unique voter identification number assigned to the voter; 
  6. The voter’s current address of residence; 
  7. The voter’s previous address of residence; 
  8. A copy of the voter’s registration form. 

(B) The [chief election official] shall prescribe the manner and frequency in which the [responsible election officials] must record and transmit the information collected under subsection (A) but, at a minimum, such transmissions must occur at least [once every quarter] in a calendar year.   

(C) If a registered voter’s information is transmitted to the [chief election official] pursuant to this Section, a record of such transmission shall be included in the corresponding voter’s registration record. This record shall be treated as a voter list maintenance record and shall be stored with the voter’s registration record for the duration of time the voter continues to be registered in this state. 

Section 3. Section [         ] is enacted to read:  Duties of [Chief Election Official]; Notice Regarding New Voters 

(A) After receiving a registered voter’s information provided under Section 2 of this Act, the [chief election official] of this state shall send notice to the chief election official in the jurisdiction where the individual was previously registered to vote informing them that (1) the identified individual was successfully registered to vote in this state, (2) the individual listed a residential address located in this state on their voter registration application, and (3) the individual has requested cancellation of their voter registration in the recipient official’s state. The [chief election official] shall include with this notice a copy of the voter’s registration form or the information obtained pursuant to Section 2(A) and shall provide any other relevant information requested by the recipient official’s state.  

(B) The [chief election official] of this state shall cause a report to be issued at least [every quarter] in each calendar year that publicly reports: 

  1. the total number of notices sent pursuant to subsection (A) of this Section since the last report, the states to which they were sent, and the number of notices sent to each listed state; and 
  2. the total number of records received indicating voters registered in this state have applied to register in another state and their disposition.  

(C) Information received by the [responsible election official] from an election official in another state indicating that a registered voter in this state has registered to vote in that other state shall be deemed a request from the voter to have the voter’s name removed from the statewide voter registration system. The [chief election official] shall periodically make said information available to the [registrar]. Upon receipt of such information, the voter shall be immediately removed from the statewide voter registration list.
