ALEC Policy Champion Advances Judicial Deference Reform in Alabama
Congratulations to Sen. Orr on his third ALEC Policy Champion award, and to the Alabama Legislature for pushing through a meaningful achievement for judicial independence in Alabama.
Alabama is the latest state to meaningfully strengthen the separation of powers with the passage of SB167, a judicial deference reform championed by Sen. Arthur Orr. The legislation, which now awaits the signature of Gov. Kay Ivey, marks a decisive step toward restoring the judiciary’s independent role in interpreting law.
SB167 ensures that courts no longer defer to administrative agencies on questions of law, reinforcing the principle that judges—not unelected regulators—have the final authority to interpret statutes. This reform brings greater accountability to the administrative state and helps prevent agencies from expanding their own power beyond legislative intent. Alabama’s legislative win closely aligns with ALEC’s Judicial Deference Reform Act.
Sen. Orr’s leadership on this issue reflects a clear commitment to constitutional governance and the rule of law. By advancing this reform, he has helped position Alabama among a rapidly growing number of states working to rebalance power between the branches of government, particularly in matters of judicial deference to the executive branch.
The Judicial Deference Reform Act is one of several model policies highlighted in ALEC’s Essential Policy Solutions for 2026 that instructs legislators on how to achieve substantive regulatory reform. Restoring the proper balance between the branches of government while emphasizing accountability and oversight of the executive branch is a key focus of the publication’s guidance, and likewise, the 2026 priorities of legislatures throughout the United States.
Congratulations to Sen. Orr for his third ALEC Policy Champion award, and to the Alabama Legislature for pushing through a meaningful achievement for judicial independence in Alabama.
