Valid Voter Identification Act
Voter Identification
- A. All voters are required to present a physical valid photo identification (ID), as listed below, to an appropriate election official before voting in person.

- 1. Acceptable forms of identification shall include:

- a. A driver’s license properly issued by the appropriate state or county department or agency;
-

- b. A state non-driver’s ID card properly issued by the appropriate state or county department or agency;

- c. A current, non-expired U.S. passport;
-

- d. U.S. military ID, provided that such ID contains a photograph of the voter;
-
-
-
- e. Tribal government ID, provided that such ID contains a photograph of the voter;
-
-
-
- f. A valid [state] photo voter identification card or other valid identification card issued by a branch, department, agency, or entity of the [state] or the United States authorized by law to issue personal identification, provided that such identification card contains a photograph of the voter.

- B. For electors wishing to vote by mail:
- 1. An elector voting by mail must write on the absentee ballot application their drivers license or non-driver id identification number, or the last four digits of their social security number, or the unique voter ID number assigned to the voter by the election office, or include a photocopy of a valid form of ID specified in A1.
- 2. An elector voting by mail must write on the [privacy sleeve or envelope] accompanying the ballot their drivers license or non-driver id identification number, or the last four digits of their social security number, or the unique voter ID number assigned to the voter by the election office, or include a photocopy of a valid form of ID specified in A1.
- C. For individuals physically unable to travel to a state or county office on their own in order to obtain a state ID:
- 1. [State] shall provide the appropriate transportation from the individual’s residence to the ID office and back.
- 2. Alternatively, [state] shall provide a mobile vehicle to travel to the homes of permanently disabled individuals to provide them with an ID.
- 3. If a voter does not possess a state-issued ID, the state shall provide one to the voter free of charge through the Department of Motor Vehicles, county election offices, or other state entity as provided by law.
- D. If election officials have a photograph of a registered voter, all poll locations using electronic poll books shall have the photograph of the voter available with the registration information of the voter.
- 1. Any other agencies of [STATE] that maintain verified identification information with photographs shall provide such photographs to election officials in an acceptable format.
- 2. Relevant election officials and such agency officials described in (a) shall develop a process for the timely exchange of this information; provided that, in addition to the above, the election official may require the transmission of such information thirty (30) days before voting opens.
- E. A voter whose voter ID does not comply with the provisions of this Act shall be issued a provisional ballot, which shall be counted only if the voter is able to provide the voter identification required under this Act within three (3) days following the election in which the voter was issued the provisional ballot.
[*For states that provide free photo identification cards for the purposes of voting, a provision using the following language should be added to statutes governing the issuance of these cards: (A) The [governmental agency responsible for issuance] shall not issue an [election identification certificate/voter identification card/voter photo identification card] to any person who is not a citizen of the United States]
