ALEC Policy Champions Expand Virtual Learning in Texas

ALEC commends Sen. Paul Bettencourt and Rep. Keith Bell for their dedication to advancing virtual and hybrid learning options.

The American Legislative Exchange Council (ALEC) proudly recognizes Texas Sen. Paul Bettencourt and Rep. Keith Bell for their leadership in passing SB 569, a major piece of legislation that modernizes and expands virtual learning opportunities across Texas. Signed into law by Gov. Greg Abbott on May 6, 2025, the bill establishes a comprehensive framework for virtual and hybrid education, aligning closely with ALEC’s Statewide Online Education Act, one of the ALEC Essential Policy Solutions for 2025.

SB 569 completely rewrites the state’s previous patchwork of virtual learning regulations with a unified, statewide structure that emphasizes flexibility, accessibility, and accountability. Some of the most significant changes include:

  • Allowing students to take AP, dual-credit, or specialized elective courses virtually.
  • Allowing students to complete up to two years of college coursework while in high school (this can be done through in-person, hybrid, or virtual learning).
  • Creates flexible pathways for students to earn apprenticeships, participate in career training programs, or graduate high school early through hybrid learning opportunities.
  • Requires the Texas Education Agency to publish a list of available virtual courses, including costs and third-party providers.
  • Requires school districts to consider virtual or hybrid learning as an alternative to expulsion.

More than 51,884 students across Texas are currently enrolled in virtual schools, and this figure is projected to double by 2028. SB 569 makes crucial changes to the state’s virtual learning laws and creates an environment where high-quality virtual and hybrid learning options can flourish. It also creates numerous new pathways for high school students to earn credit toward a college degree, complete advanced placement courses, participate in apprenticeships, and more.

Bettencourt’s leadership on the Texas Commission on Virtual Education and his commitment to expanding educational opportunities were pivotal in the development and passage of SB 569. Bell has also been a tireless advocate for virtual education options in the House and played a major role in the bill’s successful passage. Their collaboration resulted in a transformative policy that will benefit thousands of Texas students.
